Concerns about connecting Aadhar to PAN remain, especially for NRIs and OCIs. A few of you have come to me complaining that the inability to link your Aadhar has made it difficult for you to get tax refunds. This short essay tries to explain the background of this problem and offer advice on how to fix it if you’ve run across similar issues.

Context

 

With a deadline of June 30, 2023, the Indian Income Tax Department ordered all resident PAN cardholders to connect their Aadhar cards to their PAN numbers. However, NRIs and OCIs are exempt from this requirement.

After the connection deadline passed on July 1, 2023, the tax agency designated as “INOPERATIVE” any PAN cards that were not connected to Aadhar. NRIs and OCIs were exempt, although their PAN numbers were designated as inactive.

Implications of the INOPERATIVE PAN Status

NRI/OCI is primarily impacted by two issues:

 

(a) Tax Refund: They do not get reimbursements for their taxes.

(b) Not Being Able to File for a Lower Tax Certificate: This has an impact on sales of real estate and rental revenue.

A few of you have mentioned that when you log into the IT site, your PAN shows as “ACTIVE.” But “ACTIVE” status is not the same as “INOPERATIVE” status.

Go to Profile, then Personal Details after logging into the IT portal to verify.

A paragraph that reads, “The details as per your Profile and PAN may not be matching,” is located underneath this. You can disregard small address changes. If you would like to update, you are free to do so. Click here to view. Kindly click this link to see your profile page. Verify whether it is inoperative.

Should it appear as INOPERATIVE, kindly forward a letter to the following email addresses.

From: the email address you registered with on the income tax portal

Subject: PAN activation request (allude to your PAN) ALxxxxxx

Regards: jd.systems1.1@incometax.gov.in, adg1.systems@incometax.gov.in

My PAN number, ALXXXXXX, is listed on the Income Tax portal as “inoperative.”

I currently reside in [state and country] as an NRI/OCI (adjust according on your status). I don’t have an Aadhar card since NRIs and OCIs are not required to link their Aadhar to PAN numbers. In light of my NRI/OCI residential status, I respectfully ask that you initiate my PAN.

For your information, I’ve included copies of my US passport and PAN (as modified per nation).
